All contracts and transactions governed by these terms shall be construed in accordance with Dutch law and mandatory European Union consumer rights directives.
2. Order Processing and Shipping
- Carriers and Standard Transit Times: We collaborate with major established logistics providers, including DHL, FedEx, and UPS Priority services, to dispatch our compact furniture products. Standard delivery typically requires between 6 to 12 working days following order fulfillment.
- Automated Tracking Notifications: To keep you informed throughout the delivery process, our system automatically dispatches tracking updates to the email address provided at the time of your order at key logistical milestones, including order dispatch, arrival at local logistics hubs, and local out-for-delivery status.
- Transit Delays and Investigations: Should an order exceed the standard delivery window, our team will initiate a formal investigation with the respective carrier. Based on the findings of the carrier investigation, we will determine appropriate resolutions, which may include a full refund or a replacement shipment.
3. Risk of Loss and Delivery
In accordance with European consumer protection legislation, the risk of loss or damage to goods remains with minifurnish.com until the consumer (or a third party indicated by the consumer other than the carrier) has physically received the goods. The risk does not transfer to the customer upon handing the goods over to the carrier.
4. Right of Withdrawal (Returns and Cancellations)
As our target market is situated within the European Union, consumers benefit from statutory rights under the European Consumer Rights Directive.
- 14-Day Withdrawal Period: You have the statutory right to withdraw from your purchase contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
- Exercising Withdrawal: To exercise the right of withdrawal, you must inform us of your decision via an unequivocal statement sent to our customer support email at furniture@minifurnish.com.
5. Defective or Damaged Items Upon Receipt
If you receive an item that is defective, flawed, or damaged upon delivery, you may contact our customer support team via email at furniture@minifurnish.com within a reasonable timeframe.
- To expedite resolution, customers are required to provide clear photographic evidence illustrating the reported defect or damage.
- Upon verification of the photographic evidence, we will process a full refund or arrange a replacement item as appropriate. To minimize unnecessary logistical burdens regarding damaged goods, physical return of the damaged item is not required when valid photographic evidence is supplied.
6. Limitation of Liability and Governing Regulations
Nothing in these Terms of Service shall exclude or limit any consumer rights or statutory liabilities that cannot be excluded under Dutch or European Union mandatory law. Our total liability for any claim arising out of or relating to a purchase shall not exceed the total purchase price paid by the customer for the specific product in question.
